Workers’ Community Mourns One of the Honest Colleagues on April8, 2008

With the sorrow and sadness, be informed that Janek Kuczkiewicz, the Director of Workers and Human Rights Department at the International Trade Union Confederation, 52, passed

Happy May First, International Labor Day

The Syndicate of the Workers of Tehran and Suburban Bus Vahed Company congratulates the International Labor Day to our hardworking colleagues at Vahed Company and all the workers in Iran and around the world.

As an international tradition, in all countries, workers express their demands and protests through the observances of International Labor Day. Governments in all the countries are aware of the importance and sensitivity of the International Labor Day, and they respect it by fixing May First as a national holiday and celebrating it in public.

In Iran, with a more than a century syndicalism history, started during civil revolution and continued during the oil nationalizing and the recent revolution, sorrowfully, workers are deprived of their legitimate rights to be organized within the independent labor syndicates, despite the fact that there is any legal obstructions, and this is not the honor for a country which is a member of ILO for more than half a century.

The Syndicate of Workers of Tehran and Suburban Bus Vahed Company is appealing authorities of three governance powers to end repressing and preventing syndicalism activities, release Mr. Mansour Osanloo, the president of the Executive Board of the Syndicate, and take proper measures to return the members of the Syndicate of Vahed to their jobs.

The Syndicate of Workers of Vahed Company supports all the rights seeking actions of workers in Iran and all around the world, and thanks all the workers, global trade unions, including International Trade Unions Confederation (ITUC) and the International Transport’s Workers Federation (ITF), and all the people who are seeking democracy, justice and peace for their collaboration to defend our rights.

With hope of holding independent labor syndicates, social justice and global absolute peace

Ebrahim Nouroozi Gowhari, a member of the Syndicate of the Workers of Vahed Company, summoned by the Revolutionary Court

As reported by Dastranj, the Public Outreach of the Syndicate of the Workers of Vahed Company announced that Ebrahim Nouroozi Gowhari, a member of the Syndicate, would attend the branch 14 of the Revolutionary Court.

The reason of this summons is his participation in the trade unionism’ protest of workers of Vahed Company in 2005. His case is one of those 16 files which had been opened in the judicial system for their protest in 2005.

In the winter of 2005, the workers of Vahed Company went to strike because their trade demands had not been fulfilled. During this protest, many of the workers, including the members of the Syndicate of Workers, were arrested by the disciplinary agents. After a while, the judicial system ordered to stop prosecution of detained workers, and many of them were returned to their previous job; still, sixteen of workers have their files open.

Mansour Osanloo, Ebrahim Madadi and Ali Zad Hosein are some of those workers whose cases were tried by the judicial system. Mansour Osanloo, the president of the Syndicate, is serving his 5 – year prison sentence. Ebrahim Madadi, the vice president of the Syndicate, as it was said, has been sentenced to three years and a half term prison, but he has not received the verdict yet. Ali Zad Hosein, a member of the Syndicate, was sentenced to 10 – month suspended prison a while ago.

A Poem by Mansoor Osaloo

You and knowledge and love are with me

I was walking in ignorance

You and kiss and kindness are in my mind

Flower and bud and bullet were in my mind

My many loves are interwoven

Loving you

Loving people

Loving God

Loving Love

My love for the Syndicate

With your love for me

What crime we did commit

When we spoke and wrote

We love

How bitter and how sweet it was

Today we were tried, too

On charges of the Syndicate

Moments after moments my dreams grey and at times red

And my shirt is yellow and orange

Now when I am with my people

My shirt is blue

In the color of the workers’ shirt at the Vahed Company

And the dark blue suit

In the color of the drivers’ suit at the Vahed

And how magnificent is it

The moment that they sing the song of birth

The triumphant workers at the Vahed Company

Solidarity Message to the Transportation Workers in France

Dear Fellow Workers and Co- Fighters

We learnt that the government in France has developed a plan as a part of globalization which would violate the rights of the retired workers, and the Syndicates in France have staged and organized the large scale strike to defend workers rights and prevent the invasion of capitalism to pummel workers rights.

The Syndicate of Workers of the Tehran Bus Company, Vahed, fully supports this magnificent movement and announces unequivocally, “You are voicing out the World’s Workers Common Pain.” Attacking the workers achievements are the plans of the majority capitalistic governments under the globalization name which would be led to disaster, poverty, and workers’ unemployment. We stand up with you in this struggle.

As you are aware, the workers of the Syndicate of the Vahed Company have been under the hardest pressures for three years, because of forming their independent union which is their very basic workers rights and has been recognized internationally. At the moment, Mansour Osanloo, the President of the Syndicate, and Ebrahim Madadi, the Vice President of the Syndicate’s Executive Board, are in jail for defending workers’ rights, and the members of the executive boards have been dismissed and have been wandering in the judiciary’s building.

We believe that your victory is the victory of all workers, and the international workers’ unity and solidarity to fight for the better and decent life for the human being by eliminating this injustice is the only way of rescuing ourselves.

Once again, we support your powerful strike and hope success in this united struggle.

With the hope of expansion of Peace, Justice and Freedom across the World

Defence Bill of Ebrahim Madadi

by

Dr. Yousef Mowlaiee and Parviz Khorshid

                                                                                       November 2007

The Esteemed President of the Tehran Province Court of Appeals

Your Honor,

In protest at the verdict issued by the Tehran Court of Revolution, chamber 28, regarding the case number T/8861/186, the following issues are being informed:

1.      According to the Article 214, the court should issue reasonable and justified order by referring to the legal articles and principles. This article has been proposed to respect the guiltlessness principle and put the heavy duties on the court’s shoulders. To respect the guiltlessness principle, the esteem court should order charges against the accused person based on the strong reasons, otherwise, at the judgment status, it violates principle 27 of the Constitution of Law. In the criminal affairs, reasons have been identified and court would evaluate the attributed reasons within the legal framework. The judge does not have the right to issue sentences based on the assumptions, what has been heard or said, and pre judgments. On the other hand, the court does not have the absolute power and authority in referring to the legal articles. However, based on the case situation, the way of forming the material element (the actions which could be attributed to the accused person) and the mental element (the knowledge and intention of the accused have been known) the court should identify the appropriate referral legal article, and be fully careful in the adoption of the articles with the accused actions.  Regarding these matters, the issued indictment is not strong enough because of the following reasons:

a.        In the issued indictment, there has not been given any reasons to prove that conspiring collectively has been taken place. The statements of the accused person, the officers’ report and the contents of the file have been referred as the reasons of issued verdict in the indictment. The accused person, in all the interrogation meetings and in his defence at the court, clearly stated that he intended to go to Osanloo’s house and he was arrested before he entered in. The reports by the officers and agents also indicated that Mr. Madadi was arrested before he entered to Osnaloo’s house.

b.      Conspiring and gathering requires of the participation of at least two people. In the present case, nobody has been sentenced as the Madadi’s accompany in the gathering and conspiring. Whereas if the gathering and conspiring had been taken, Mr. Madadi along with the other people who gathered and conspired with Madadi as partners, assistants or supervisors, should be tried within the one case. The arrested people along with Mr. Madadi were freed with the order to stop further following up.

c.       The material element of the attributed crime, which had not been reasonably proven by the court, was replaced with the intention of the crime, and Mr. Madadi, according to the issued indictment, was sentenced because he had the intention of disturbing the national security. Regardless of the fact that the mental element can not be referred as a reason in the absence of the material element, in this case, the court denied to submit the reasons of the criminal intention.

d.      Most part of the indictment has been allocated to the client’s trade union activities at the Syndicate of Vahed Company which indicates that action of going to Mr. Osanloo’s house by my client has no criminal dimension and the client has been sentenced because of the charges irrelevant to this case, and it is against the principles of the fair trial, procedure of the criminal trial, and civil rights and respect the legal and legitimate freedom.

e.       If we accept  that the assumption of Mr. Madadi’s intention of gathering in front of  Mr. Osnaloo’s house  had been proven, regardless of the fact that any gatherings has not the criminal attribution and only the gatherings which led to the crime should be followed up, as the Disciplinary Forces arrested Mr. Madadi before he entered to Mr. Osanloo’s house, this criminal action can be considered as the abortive crime and maximum the start point of the criminal action for which no sentences had been predicted, according to the law.

2.      Criminal Mental Element of Article 610

Referring to the article 610, a crime can be considered if, first of all, the intention of the accused person to conspiring and gathering to be known, and secondly the intention of criminal action (action against the security) through the conspiring to be proven. The respected court in any of the mentioned matters has not submitted any reasons, and has not proven the specific or public intention by the accused person.

Therefore, regarding this bill of defence and referring to Principle 27 of the Constitution of Law, we request the order of breaking the issued verdict, and writ of guiltlessness of the accused person from the attributed charges. Also, for more information, the legal issues of the Article 610 are being described to the esteem Court of Appeals as follows:

1)      Material Element in Article 610

Offence of gathering and conspiracy for commitment of an offence will be materially realized when at least two people jointly commit an offence. In other words, the main and key element of realization of provisions of this article is commission or omission of a criminal act by individuals and on the other hand the consequences of these crimes or their effects should be damaging and undermining the country’s security. In this article the criminal act is defined as activities and doings with special particulars which considering the intensity of the act and its consequences, they are considered as dangerous offensive acts. For example creating fear and danger, committing wicked acts, using cold and warm arms, robbery, kidnapping are some of the examples of such crime. In this case, in addition to criminal act, the means and method of commitment and partnership of at least two people are required in what is considered a crime under article 610, and thus it is logically impossible to regards our client’s activities which include giving lectures, issuing statements and holding Syndicate meetings as examples of crime under 610. His behavior and activities have not the criminal description. Establishing Syndicate with the votes of the majority of the workers at the Vahed Company is not a crime. Participation and gathering of the workers at the Vahed Company for their trade union affairs and claim the trade’s rights, according to Principle 26 of Constitution of Law, can not be considered a crime.

2)      Mental Element

Considering the mental element of crime, it should be mentioned that the subject of article 610 is public offence, its conditions will be satisfied taking into consideration the criminal intention and its consequences in internal security. In other words the perpetrator should commit the crime intentionally and jointly wit at least one another person and in addition he should have bad intention in his deeds.

In a situation that none of the Syndicate activities are considered as offence and supposedly if the Syndicate is not officially recognized, it will not benefit from any legal privileges. Thus, my client has not committed any crime in his Syndicate activities and recognition of his bad faith, general or particular subject of article 610 is nonsense. As reflected in the records and our client has announced in the court, the objective and intention of the client and other members of the Syndicate have always been defending legal trade rights through peaceful activities and the result of such activities is reinforcement of  national security through preventing the claims of deprived layers of the society to be radicalized. Defending the workers’ rights with good faith is an evident of his good faith in organizing the affairs of his area of working and removal of managerial deficiencies, and finally Mr. Madadi’s deeds and behavior has been in the direction of justice benevolence. There is no trace of bad faith and consequently article 610 does not apply to his case.

Syndicate of Vahed Strongly Condemns the Unfair Verdicts of 5 Years Prison for Mansour Osanloo and 2 Years for Ebrahim Madadi

Whereas always the Supreme Leader and government’s authorities encourage all people to engage in their own fate and defend their rights by being in present at any scene, whenever workers defended their legitimate rights they have been faced with the judiciary system and prison. Nowhere in the Constitution of Law, Labor Law, Civil Rights, and Islamic Sharia Laws has been written that the consequences of defending workers rights would be prison, repression and dismissal.  Creating the atmosphere and preparing the environment by infusing the idea of arresting labor activists whenever they want to arrest a worker’s activist, imprisonment of workers, secret courts, unofficially informing workers from the issued verdicts, and long term prison sentences are not the generous awards to the labor activists who devote their entire life to get the workers legitimate rights. Any enlightened conscience doesn’t accept the way that workers have been treated with contempt.

Syndicate of Workers of the Tehran and Suburban Bus Company, Vahed, strongly condemns the unfair verdicts of five years prison for Mansour Osanloo, because of his trade and syndicalism’s activities, and two - year prison sentence for Ebrahim Madadi, only because he went to Mansour Osanloo’s house to express his sympathy with his family, and requests all international labor organizations to react seriously to this unfair and anti-workers decision globally.

We address this special message to you as we learnt that the annual meeting of the Coordinating Committtee of the ITUC affiliates in the Middle East and North African would be held in Brussels next week. Free Two Imprisoned Syndicalists

Sorrowfully two imprisoned syndicalists, Mr. Mansour Osanloo and Mr. Ebrahim Madadi have been sentenced to five and two years prison, respectively. What crimes have they been committed to? Are defending syndicalism’s rights and demanding to form the independent syndicate of workers at Vahed Company considered crimes?

Dear Esteemed Judiciary Authorities!

The principle 165 of Constitution of Law requires all trials to be open to the public with the presence of defending attorneys. Why were the cases tried in these hearing while none of the attorneys, families, and workers of the Vahed Company was in present, in order to find out for which criminal activities the members of the Syndicate’s Executive Board were sentenced?

Why do you think that the activities of the two members of the executive board of the Vahed’s Syndicate are against national security? Why are the defenders of the legitimate rights of workers at Vahed Company, who live under the poverty line and should receive more attention, being treated with oppression and unkindly? How long would the trade and syndicalism’s activities pay this large amount of cost? At the moment, more than 30 workers of the Vahed company have been suspended and they are financially embarrassed, and about 13 of the workers have received the reinstate orders from the board of dispute resolution  of Labor Ministry, but the managers of the Vahed Company denied to accept them. These workers are the hardest workers in the society and are in a hard living condition.

We ask the esteemed head of the judiciary power to free the two imprisoned syndicate’s workers immediately.

The Founding Board of the Workers’ Syndicates, expressing the sorrow at the issued verdicts, demands the immediate release of Mr. Mansour Osanloo and Mr. Ebrahim Madadi.

October 14, 2007: Hanafi Rustandi, ITF Representative, in Iran

The Response of Iranian Authorities to the International Labor Federation

The representatives of International Transport Workers’ Federation didn’t succeed to meet labor minister, deputies, and managers in their mission to Iran.

Etemad e Meli, Amir Godarzi - Two workers’ rights defenders from Indonesia, last week after entering to the country, announced that they traveled to Iran to investigate the situation of imprisoned workers of the Vahed’s Syndicate. They tried to meet the labor authorities and they knocked any doors, even they went to the minister’s house.  The ITF and ITUC’s representatives, faced with the closed door, while were on their way back to Indonesia, with the absolute certainty, said that they would come back soon with a high level mission.  “Mansour Osanloo” was the core issue that took the representatives of International Federation to our country, and made David Cockroft, ITF General Secretary, to send the mission. Osanloo, the labor activist at the Tehran and Suburban Bus (Vahed) Company, was arrested after he got off the bus several months ago, and there was no news about him for a while. His family, after continuous following up, was able to visit him by phone only once. At the moment, It is said that Osanloo has an eye problem and he faces new charges after he was arrested.

After Osanloo was arrested, on August 9, 2007, some of the workers of Vahed Company went to Osanloo’s house to visit his family and express their sympathy. As they were about entering to his house, eight of them were arrested and transferred to prison. After a short period of time, six of the detainees were released, but Ibrahim Madadi, one of the worker’s activists, is still in detention. Activists tried hard and followed up Madadi’s case to clarify his situation as far as the International Trade Unions in Indonesia met Iran Ambassador in Indonesia, but ITF, International Transport Workers’ Federation, and ITUC, International Trade Union Confederation, didn’t gain anything from this meeting. So, they decided to travel to Iran to fulfill their trade unions objectives. Syukur Sarto, General Secretary of Indonesian Trade unions Confederation, and Hanifa Rustandi, Chair of the ITF’s national coordination committee in Indonesia, entered to Iran as a tourist to investigate the situation of the imprisoned workers, because, as they said, they faced with the hard situation to get visa. Whereas Sarto and Rustandi looked very tired from their short time trip, and they didn’t do as much as they thought, but it didn’t seem that they were upset.  A couple of hours before their flight back to Indonesia, they answered any questions that came to my mind and I asked. They told me that they came to Iran to investigate about two imprisoned workers of the Vahed’s syndicate, and to pursuit the implementation of ILO Convention No. 93. Rustandi about the difficulties of traveling to Iran said, “The first problem was that they didn’t give us the visa. We had an official invitation letter from the Vahed’s Syndicate and the mission letters from ITF and ITUC.  We didn’t want to play hide and seek, but we forced to enter as a tourist.” Sarto approved it. He continued by describing the achievements of their mission to Iran: ‘We knocked every door in order, at least, to visit one of the authorities, but none of them accepted it. On Wednesday, we knocked the  door of the labor minister’s house because we wanted him to clarify many vague issues for us, and we heard a negative answer again.  None of the ministry deputies and general directors and etc., didn’t respond us. Even we sent our request to the international relation of the Foreign Ministry, but we haven’t had any visit yet.”  When he answered to my question, whether or not they would travel to Iran again, “We will travel to Iran again”, I asked, “How are you sure that you won’t face with these problems again?” He answered, “We will report all these to ITF and ITUC in order they solve the problems at the highest level with the authorities in Iran. Definitely our next mission will be at the high level, so we will deal seriously, without any hide and seek, with the labor issues.” Sarto, after his colleagues finished his words, in response to the question, whether workers in the other countries faced with these problems, said, “Yes, not only in the undeveloped countries but also in the developed countries workers deal with these problems; such as Japan. For this reason trade unions’ demands form differently in all countries. Iran as a rich and beautiful country has workers with their own problems.” Rustandi and Sarto, both, think that forming union, joining the international federations, and trying to get their trade’s rights is the way of solving workers’ problems. They repeated these words so many times, and it made me to ask them at the end of the interview, “so, when do workers work?’ Rustandi answered before his colleague and said, “You proposed a very important issue. Workers should work and they are not able always to follow up their rights. In this way, the other social strata should help them.” These workers’ rights defenders, on last Wednesday, said good bye to  dozens of  workers, who are now a little more  hopeful, and flight to home after a short trip, and a visit with Mr. Osanloo’s and Mr. Madadi’s Families.

Visiting Indonesians was useless

The international Trade Unions Officials complained the labor authorities, rather were upset with Osanloo and Madadid’s attorneys. Yousef Mowlaie and Parviz Khorshid didn’t visit with Rustandi and Sarto. Mowlaiee about this decision said to Etemad Melli reporter, “They haven’t any position that we wanted to meet them. If one day judiciary officials ask us with which permission we met them, what shall we say?” When I reminded them that they came officially on behalf of the International Workers’ Federation, he said, “According to law, a person has a position who is allowed to interfere and follow up the case.” It was said that the attorneys had set conditions for meeting with Indonesians, and Mowlaie pointed out, “If they agreed that we met in a press conference, we wouldn’t refuse it, but private meeting wasn’t acceptable for us.” Mowlaie, also, said, “It is not clarified in Law whether or not this type of meeting is forbidden.” In response to the question, whether this meeting would affect on the file procedure, he said, “No, not at all. If we thought that there would be any positive impacts, and it would facilitate the release of our clients, we have never lost the moment. The representatives were not in the position to have impact on the cases. They only helped the families of detainees and activists to calm down.”  As the attorney of the imprisoned workers of Vahed Company said if these representatives have had capacity to influence on cases they would play their roles without coordinating with the defending lawyers. He believes that the responsibility of the defending lawyer makes him to work within the framework that is identified by law. Mowlaie about the case of his clients mentioned that even the indictment has been issued for Mr. Madadi, but he doesn’t know about the charges against him: “Osanloo’s case is at the primary investigation, so I don’t have access to his file. Madadi, same as my other client, is in Evin prison based on the detention order, but the indictment against him is ready to be sent to court.” In response to the question about Madadi’s charges, he said, “I have no idea about my client’s charges; I probably will be informed in the court tomorrow.”
